2. Verify.Dog Relationship

Doggywood is sponsored and operated by Pet Platforms, Inc. dba Verify.Dog.

Verify.Dog may provide identity verification, account verification, mobile verification, email verification, dog identity services, or related infrastructure used by Doggywood.

A person does not need to be an existing Verify.Dog customer merely to participate in Doggywood unless a specific feature or contest expressly states otherwise.

3. Additional Terms

Certain Doggywood services are subject to additional terms.

These may include:

These additional terms are incorporated into these Terms by reference.

If the Official Rules for a particular contest conflict with these Terms regarding the operation, entry requirements, voting rules, prize, winner determination, tie breaker, or administration of that contest, the applicable Official Rules control for that contest.

4. Eligibility

You must have legal capacity to agree to these Terms.

You must be at least 18 years old to enter a Doggywood contest unless the applicable Official Rules expressly provide otherwise.

Other Doggywood features may be subject to separate eligibility requirements.

5. Accounts and Identity Verification

Certain features may require an account or verified identity.

Doggywood may require verification using information such as:

  • Mobile number
  • Email address
  • Account identity

You agree to provide accurate information.

You may not impersonate another person, create accounts using false identities, or use another person’s account without authorization.

You are responsible for activity associated with your account to the extent permitted by law.

6. Account Security

You must take reasonable steps to protect access to your account.

You must not intentionally permit another person to use your account to bypass voting limits, contest restrictions, identity requirements, or other Doggywood controls.

Doggywood may restrict or suspend access when we reasonably believe an account has been compromised or is being misused.

Doggywood contests are intended to be competitions based on published contest criteria and voting rules, not random drawings unless a future promotion expressly provides otherwise.

9. Voting

Official Doggywood votes must be recorded through the Doggywood voting system.

Likes, comments, shares, reactions, views, or votes occurring on outside social media platforms do not constitute Doggywood votes.

Doggywood may require voter verification before accepting an upvote.

Doggywood may impose limits on voting, including limiting a verified voter to one vote for a particular entry during a contest.

The applicable Official Rules determine how votes are counted for each contest.

10. Voting Integrity

We do not guarantee that Doggywood will always be uninterrupted, error free, secure, or available.

We do not guarantee that every upload, vote, communication, or feature will be available at all times.

29. Limitation of Liability

To the fullest extent permitted by applicable law, Pet Platforms, Inc. dba Verify.Dog and its affiliates, officers, directors, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to Doggywood.

Before starting arbitration, you and the Company agree to attempt in good faith to resolve the dispute informally.

A user must submit a dispute notice through the contact form available on Doggywood.com.

The notice should provide sufficient information to identify:

  • The person submitting the dispute
  • The account involved, if applicable
  • The nature of the dispute
  • The relief requested

After receiving a complete dispute notice, the parties will have 30 days to attempt informal resolution.

If the matter is not resolved during that period, either party may initiate arbitration.

32. AGREEMENT TO BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for matters expressly excluded below, any dispute, claim, or controversy arising out of or relating to:

  • Doggywood
  • These Terms
  • An account
  • A contest
  • An entry
  • Voting
  • Winner determination
  • User Content
  • Communications
  • A prize
  • Our relationship with you

will be resolved through final and binding arbitration administered by the American Arbitration Association, AAA.

For disputes involving individual consumers, the arbitration will be administered under the AAA Consumer Arbitration Rules and Mediation Procedures then in effect, unless the AAA determines that another set of AAA rules applies.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement to the extent applicable.

The arbitrator may award any individual remedy or relief that would otherwise be available in a court of competent jurisdiction, subject to these Terms and applicable law.

The arbitration award will be final and binding.

33. Arbitration Procedure

A party seeking arbitration must comply with the applicable AAA filing requirements.

The arbitration may occur through documents, video conference, telephone, or an in person hearing as permitted by the applicable AAA rules and determined under those rules.

The location of any required in person proceeding will be determined under the applicable AAA rules unless the parties agree otherwise.

The allocation of arbitration filing fees, administration fees, and arbitrator compensation will be governed by the applicable AAA Consumer Arbitration Rules and fee schedule, except where applicable law requires a different allocation.

34. Small Claims Court

Either party may pursue an individual claim in a small claims court of competent jurisdiction if the claim qualifies and remains on an individual basis.

35. Temporary Court Relief

Either party may seek temporary or preliminary court relief when reasonably necessary to protect intellectual property, prevent unauthorized system access, preserve evidence, or maintain the status quo pending arbitration, where such relief is permitted by law.

Seeking such relief does not waive the obligation to arbitrate the underlying dispute.

36. WAIVER OF JURY TRIAL

TO THE EXTENT PERMITTED BY LAW, YOU AND PET PLATFORMS, INC. DBA VERIFY.DOG WAIVE THE RIGHT TO HAVE DISPUTES COVERED BY THE ARBITRATION AGREEMENT DECIDED BY A JUDGE OR JURY IN COURT.

37. CLASS ACTION WAIVER

To the fullest extent permitted by applicable law, you and Pet Platforms, Inc. dba Verify.Dog agree that disputes covered by the arbitration agreement must be brought solely in an individual capacity.

Neither party may bring or participate in a class action, collective action, consolidated action, representative action, or private attorney general action where such waiver is enforceable.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim.

38. Governing Law

These Terms and your use of Doggywood are governed by the laws of the State of Florida, without regard to conflict of law principles that would require application of another jurisdiction’s laws.

The Federal Arbitration Act governs the arbitration agreement to the extent applicable.

39. Court Venue for Matters Not Subject to Arbitration

For any dispute or proceeding that is legally permitted to proceed in court rather than arbitration, you and the Company consent to the exclusive jurisdiction of the appropriate state or federal courts located in Miami Dade County, Florida, except where applicable law does not permit that limitation.

40. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect, except where applicable law requires a different result.

41. No Waiver

Failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

42. Assignment

You may not assign your rights or obligations under these Terms without our written permission.

Pet Platforms, Inc. may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, transfer of Doggywood, or similar transaction, subject to applicable law.

43. Changes to These Terms

We may update these Terms from time to time.

When changes are material, we may provide notice through Doggywood or through another reasonable method.

The updated Terms will identify their effective date.

Changes to these Terms do not retroactively alter the Official Rules governing a completed contest.

44. Entire Agreement

These Terms, together with the Privacy Policy, applicable Official Rules, and other incorporated terms, constitute the agreement governing your use of Doggywood.

45. Contacting Doggywood

Questions, complaints, legal concerns, intellectual property complaints, and other communications should be submitted using the contact forms available on Doggywood.com.
